I – INFORMATION RELATING TO THE PRIVACY POLICY OF THE SITE

This section contains information relating to the methods of management of e-xplora.it with reference to the processing of the data of the users of e-xplora.it.

This is provided pursuant to Article 13 of EU Regulation No. 2016/679, on the protection of individuals with regard to the processing of personal data and the free movement of such data, for the subjects of processing by e-xplora.it.

This information is provided only for the website www.e-xplora.it and not for other websites that may be consulted by the user via links contained therein.
The purpose of this document is to provide information on the purposes, methods and duration of processing.
The information notice may be subject to changes due to the introduction of new regulations in this regard, and the user is therefore invited to periodically check this page.

For under-age users:

  • users under the age of 18: it will not be possible to access paid services or make reservations for them or otherwise legally commit to them as required by law;
  • minors between 14 and 18 years of age may, pursuant to art. 2 of the Privacy Code, consent to the processing of their data in order to receive newsletters or receive information from the company;
  • minors under the age of 14 may not validly consent to the processing of their data for any purpose and it will be required that the person exercising parental authority or who is a guardian give consent to the processing of the data of the minor.

II – DATA PROCESSING

2.1 – Data Controller

The data controller is the natural or legal person, public authority, service or other body which, individually or jointly with others, determines the purposes and means of the processing of personal data.

2.2 – Type of data collected

Like all websites, this site makes use of log files in which information collected automatically during user visits is stored. The information collected could be the following:

  • internet protocol (IP) address;
  • browser type and parameters of the device used to connect to the site;
  • name of the internet service provider (ISP);
  • date and time of visit;
  • the visitor’s source (referral) and exit web pages;
  • possibly the number of clicks.

The above information is processed automatically and collected in an aggregate form only in order to verify the proper functioning of the site, and for security reasons. This information will be processed according to the legitimate interests of the owner.

For security purposes (anti-spam filters, firewalls, virus detection), automatically recorded data may also include personal data such as the IP address, which could be used, in accordance with applicable laws, to block attempts to damage the site itself or to cause damage to other users, or in any case harmful or criminal activities. Such data are never used to identify or profile the user, but only for the purpose of protecting the site and its users, such information will be processed according to the legitimate interests of the owner.

If the site allows the insertion of comments, or in case of specific services requested by the user, including the possibility to send the Curriculum Vitae for a possible working relationship, the site automatically detects and records some identification data of the user, including the e-mail address. This data is understood to be voluntarily provided by the user at the time of requesting the service. By entering a comment or other information, the user expressly accepts the privacy policy, and in particular consents to the processing of data and that the contents entered are freely distributed to third parties. The data received will be used exclusively for the provision of the service requested and only for the time necessary for the provision of the service.

The information that users of the site decide to make public through the services and tools made available to them, are provided by the user knowingly and voluntarily, exempting this site from any liability for any violation of the law. It is the user’s responsibility to check that he or she has permission to enter the personal data of third parties or content protected by national and international regulations.

2.3 – Purpose of data processing

The Data Controller processes the user’s personal data in order to:
a) execute any contractual relationship established between the parties (purchase and rental of products, purchase of services);
b) provide information and assistance on the Controller’s activities to those who request it;
c) send promotional communications about products or services;

Legal basis of the processing:

  • the purposes referred to in point a) have as their legal basis, the need for the Controller to fulfil contractual or legal obligations related to the contract or its establishment (art 6 paragraph 1 letter b) of the GDPR);
  • the purposes referred to in points b) and c) are based on the data subject’s consent, which will be requested each time the user wishes to submit requests for information via the website or wishes to subscribe to the Controller’s newsletter or receive information from the Controller regarding their products and/or services, as indicated in Article 6(1)(a) of the GDPR and Article 7 of the GDPR.

Provision of data:

  • with reference to the purposes referred to in point a), the provision of data is necessary for the execution of the contractual relationship in the absence of which it will not be possible to execute the contract;
  • the conferment of data for the purposes b) and c) based on the free consent of the person concerned is free and optional, in the absence of conferment the Owner will not pursue the purposes of marketing and response to requests for information.

Through their website, the Data Controller processes personal data of users. In some cases, this data may be collected indirectly – by means of the electronic tools that enable web browsing (browsers, PCs, telephones, tablets, etc.) – or may be provided directly by the user themselves, by freely conferring it (e.g. filling in forms for creating an account, entering a shipping and/or billing address for your purchases, subscribing to the newsletter, etc.).

With reference only to navigation on the site, we inform you that the Owner may process the following categories of users’ personal data: for details, please refer to the cookies policy. 
In the case of technical cookies, the provision of the requested data is necessary in order to proceed with correct navigation, without it it will not be possible to navigate (e.g. from a mobile phone, specific browser, etc.); for analytical cookies, profiling cookies, etc. the provision is optional and specific consent will be requested from the user.

2.4 – Data processing methods

The personal data collected through this website will be processed by the Owner in both paper and computerized form. Personal data, as well as any other information that can be associated with the persons concerned, directly or indirectly, will be processed by applying security, technical and organizational measures that guarantee a level of security appropriate to the risk, taking into account the state of the art and the costs of implementation.

2.5 – Categories of persons to whom your data may be communicated

Your personal data will not be disclosed, but may be communicated – where necessary to provide the functions or services requested and/or activated – to third parties (such as third party technical service providers, postal couriers, hosting providers, IT companies) appointed, if necessary, as Data Processors by the Controller pursuant to Art. 28 GDPR.

Moreover, the processing will be carried out exclusively by personnel appointed by the Data Controller and specially trained for this purpose and involved in the organization for data processing.
An updated list of the Data Processors can always be requested from the Data Controller.

2.6 – Data retention period

For the purposes referred to in point a) The Owner will process the data provided for as long as is necessary to perform the contract/request for information by the user and also after the termination of such relationship, in accordance with the terms provided for in relation to the limitation of rights (10 years unless there are interrupting events). For the purposes of points b) and c) the data will be processed until your consent is revoked. Once the aforementioned terms have expired or your consent has been revoked, the Data Controller will delete your data or make them anonymous.

2.7 – Transfer of data abroad

Users’ personal data will be processed by the Data Controller within the territory of the European Union. If for technical and/or operational reasons it becomes necessary to use subjects located outside the European Union, or it becomes necessary to transfer some of the data collected to technical systems and services managed in the cloud and located outside the European Union area, the processing will be regulated in accordance with the provisions of Chapter V of EU Regulation 2016/679. All necessary precautions will therefore be taken in order to ensure the fullest protection of personal data, basing such transfer: a) on adequacy decisions of the receiving third countries expressed by the European Commission; b) on adequate guarantees expressed by the receiving third party pursuant to Article 46 of the Regulation; c) on the adoption of corporate binding rules.

2.8 – Rights of the interested party

The Data Controller guarantees to be able to exercise the rights provided for by the GDPR at any time. In particular:

  • to access their personal data, obtaining evidence of the purposes pursued by the Controller, the categories of data involved, the recipients to whom the data may be communicated, the applicable retention period, the existence of automated decision-making processes, including profiling, and, at least in such cases, significant information on the logic used, as well as the importance and possible consequences for the data subject, where not already indicated in the text of this Notice;
  • obtain without delay the rectification of inaccurate personal data concerning him/her;
  • obtain, in the cases provided for by law, the cancellation of the data;
  • obtain the limitation of the processing or to object to the same, when allowed under the provisions of the law applicable to the specific case;
  • in the cases provided for by law, to request the portability of the data you have provided to the data controller, i.e. to receive them in a structured, commonly used and machine-readable format, and also to request the transmission of such data to another controller, if technically feasible;
  • if deemed appropriate, to lodge a complaint with the supervisory authority (see Art. 77).
  • In particular, the following rights are granted to data subjects: Articles 15 – “Right of access of the data subject”, 16 – “Right of rectification”, 17 – “Right to erasure”, 18 – “Right to restriction of processing”, 19 – “Obligation to notify in case of rectification or erasure of personal data or restriction of processing”, 20 – “Right to data portability”, 21 – “Right to object”, 22 – “Automated decision-making process concerning natural persons, including profiling” of the GDPR within the limits and under the conditions set out in Article 12 GDPR. In general, please note that for personal data processing for which the legal basis is consent, this consent may be revoked.

2.9 – How to exercise your rights

2.10 – Data security

This site processes user data in a lawful and correct manner, adopting appropriate security measures to prevent unauthorized access, disclosure, modification or destruction of data. The processing is carried out using computer and/or telematic instruments, with organizational methods and logics strictly related to the purposes indicated.

In addition to the data controller, in some cases, categories of people involved in the organization of the site (administrative, commercial, marketing, legal, system administrators) or external parties (such as third party technical service providers, postal couriers, hosting providers, IT companies, communication agencies) may have access to the data.

III – COOKIES

3.1 – Type of Cookies

The e-xplora.it website uses cookies to make the user’s browsing experience easier and more intuitive: cookies are small strings of text used to store certain information that may concern the user, his/her preferences or Internet access device (computer, tablet or mobile phone) and are mainly used to adapt the operation of the site to the user’s expectations, offering a more personalized browsing experience and memorizing the choices made previously.
